END-USER LICENSE AGREEMENT
By downloading, installing, using, or copying, any and all portion of this Application, you agree to be bound by the following terms and conditions:
License Grant and Ownership.
MediCard owns all rights, title, and interest to this Application. MediCard hereby grants you a limited, non-exclusive, non-transferable, non-sublicenseable, and revocable license to use this application. You hereby acknowledge that you are not granted with other proprietary rights, title, or licenses, by implication, or estoppel, or otherwise, under any patents, copyrights and/or other intellectual property rights. Your license to use this Application is granted by MediCard, and your license to any Third-Party Application within the site is granted by the Third-Party Application Provider. You may use the Third-Party Application at your sole risk. MediCard reserves all rights in this Application not expressly granted herein.
No Warranties.
This application including its content is provided “AS IS", “AS AVAILABLE”, and “WITH ALL FAULTS,” to the maximum extent permitted by law. You hereby agree that the use of this application is at your own risk and without warranty of any kind. MediCard hereby disclaims all warranties and conditions with respect to this Application, either express, implied or statutory, including, but not limited to, any (if applicable) implied warranties, duties or conditions of merchantability, of fitness for a particular purpose, of accuracy, of title, of quiet enjoyment or possession, completeness of responses, of results, of workmanlike effort, of lack of viruses, of lack of negligence, and of non-infringement in relation to this Application. The Data collected herein are from various sources of end-users with proper consent secured from the Data Subjects, hence, viewing or accessing is limited only to allowable entities.
Limitation of Liabilities.
In no case shall MediCard be held liable for any loss, injury, or any form of damages, including without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use this Application, or due to your reliance on the contents of this Application, however caused, regardless of the basis of liability, and even if you have been advised of the possibility of errors or damages.
Restrictions on Use.
MediCard prohibits the use or reproduction of its intellectual property or any information contained herein without its express written approval. To the extent not contrary to applicable law, you are prohibited from causing or permitting the reverse engineering, disassembly or de-compilation of this Application. You are further, prohibited from using this Application to provide data processing services to third parties without the express written consent of MediCard.
Unless otherwise specified, this Application is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Application.
User’s Responsibility.
In case any of the services on this Application requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You have to enter the password and username of your choice. You are entirely responsible for maintaining the confidentiality of your password and account. Also, you are entirely responsible for any and all activities that occur under your account.You agree to promptly notify MediCard of any unauthorized use of your account or any other breach of security. MediCard, shall not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by MediCard or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
Termination.
MediCard has the right to terminate your license to use this Application at any time regardless of the reason. Such termination, is without prejudice to the right of MediCard to enforce any remedy applicable at law in the event that MediCard discovers that your access or use of this Application is for unlawful or illegitimate purposes, or if you fail to comply with any of the material terms or conditions of this EULA. In case all your rights under this EULA terminate, you agree to cease use of this Application.
Consent to Use Data.
MediCard considers that you agree to the collection of any personal data which you provided on this Application. MediCard respects the privacy of your personal information in adherence with the Data Privacy Act of 2012. You may visit MediCard Privacy Notice. The collection of your personal information thru a Third-Party Application is outside the scope of MediCard Privacy Policy. The Third-Party Application Provider/s will acknowledge your rights and protection in accordance with their respective privacy policy upon accessing their sites.
This EULA shall be governed, construed, and enforced in accordance with Philippine laws.
Amendment.
MediCard reserves the right, at its sole discretion, to modify or replace the Terms and Conditions contained herein at any time without the need to notify its users. What constitutes a material change will be determined at MediCard’s sole discretion. By continuing to access or use MediCard’s system after those revisions become effective, you agree to be bound by the revised terms.

MediCard owns this website including all the materials on this website. MediCard prohibits appropriation, selling, distribution, modification, publication, broadcast, or reproduction of this website or any of its materials, and/or collection of data from this website, without Medicard’s prior written consent. MediCard will seriously take legal action against anyone who will violate this term.
